Introduction Inspired Life Cruises / We / Us / Our means Inspired Life Cruises. You means you and all guests in your booking. You are entering into this legally binding formal agreement and contract with Inspired Life Cruises. In order to participate in any Inspired Life Cruises, you must agree to these terms and conditions. By checking out any of the Inspired Life products on our website you are entering into a legally binding formal agreement and business relationship with Inspired Life Cruises, and, where applicable, its affiliates, suppliers and partners. The following document outlines the terms, conditions, and legal responsibilities between Inspired Life Cruises and You. It is essential you read it in its entirety, as when you purchase these cruise products on our www.inspiredlifeeventsaustralia.com.au website and tick that you agree to the terms and conditions it is considered your formal agreement to these terms and conditions.
Terms and Conditions: Are the ‘fine’ print and are a concise summary of the legal terms and conditions that you and your guests must agree to in order to cruise with us, attend our events, purchase products and remain in good standing with the Inspired Life Cruises. For Questions and Support: For any questions regarding the Product Purchase, Booking Form, Terms and Conditions, or Policies and Procedures, you may contact us on info@inspiredlifecruises.com CONSENT TO ELECTRONIC RECORD The Electronic Transaction Act 1999 states that one can meet a legal requirement for enforceability of a handwritten signature by using an electronic signature or communication. By checking box “I Agree”, you are consenting to enter into an electronic agreement with the Inspired Life Cruises. Please read the following information carefully. Should you enter into this Agreement, the entire agreement will be evidenced by an electronic record. Cruise Terms and Conditions For all enquiries, contact Donna email inspiredlifeeventsaustralia@gmail.com By providing your consent, you also confirm that you are happy to receive and able to access all terms of Agreement electronically which will be emailed to you after you have finalised your transaction. If you do not agree to anything stated below, please do not sign the form below and continue with the checkout process for any of Inspired Life Cruise’s or event products on our website. To access these documents, you will need internet access, operational internet browser (Chrome, Explorer) and Adobe Acrobat Reader. Should there be any reason to change this software requirements, Inspired Life Cruises will advise you in writing of these changes which will include new equipment and software requirements. You can withdraw your consent to the use of electronic records at any time but choosing to do this will automatically terminate this Agreement. To withdraw consent (subsequently terminating this Agreement) or provide an update of personal information, it must be done in writing. Please email info@inspiredlifecruises.com During the checkout process, you should read, download and print to retain the terms and conditions and booking form for future reference. A copy will also be emailed to you once you have finalised your checkout of the event or cruise products on our website. You may also request printed copies of these documents from your referrer. Alternatively, you can request this a current printed copy from the Inspired Life Cruises by emailing the above address. Please be advised this incurs a fee of $10AUD for this service. If you choose to do this, please include your name, contact details and email/mailing address to which you would like the Agreement sent. Please be advised however that the most current dated agreement supersedes any previous versions and is always available to download and print on the official Inspired Life Cruises website. Payment • All prices are quoted, charged and refunded in Australian dollars, unless otherwise noted. As such fluctuating exchange rates where applicable are not the responsibility of Inspired Life Cruises. • In the event that a displayed price is incorrect, subject to any requirements under the Consumer Laws, we may retract the price and/or withdraw the product from sale and refund any payments made at the incorrect price. • Sometimes we will release early bird, discounted pricing or promotional fares. These can be offered and withdrawn at any time. If after making your booking you decide to change to a discounted fare of any form, you may need to cancel your existing booking and our cancellation policy listed in our terms and conditions will then apply. We may refuse this request at our discretion. • Please note that once booked, your fare may still be subject to increases in taxes, fees and port expenses which are outside our control. You will be notified of this before it is added to your fare or your onboard account. • All payments must be made via our website www.inspiredlifeeventsaustralia.com.au in order to avoid a manual payment fee of $5 to cover staff costs to process. Page | 2 Cruise Terms and Conditions For all enquiries, contact Donna email inspiredlifeeventsaustralia@gmail.com will be displayed in your customer file on our website and you as you will receive an emailed copy of your payment to save for your records. • Please note that direct deposits may incur a manual payment fee as advised above if you have not been advised by us to pay in this manner. Make sure that you email us a copy of the payment receipt and include your booking number or last name so we able to track your payment on our accounts. Failure to do this may have your payment not allocated if we are not able to track where it comes from. • To secure early bird discounted rates and your booking, a deposit of $200 per person is required with the completion of this form if it has not already been received. • Deposit is non-refundable as it is paid straight to P & O Cruises to secure your booking. • No booking can be confirmed until the deposit is received and cleared into our account. • Full balance is no later than sixty (60) days prior to departure unless otherwise stated on the booking form. • If for any reason you notify your financial institution and do a chargeback with your bank for any portion of your fare or payment to us, your customer account with us will be automatically closed indefinitely upon notification to us from our merchant facility of the disputed purchase. You will be completely deleted everywhere, unable to attend any other Inspired Life Events and Inspired Life Cruises. This is non-negotiable. You will never be able to purchase anything from us or have any further association. • If an amount has been charged to your card that you do not recognise you should immediately contact us on the contact details via email to initiate an investigation and resolution. If the charge is found to be incorrect it will be refunded immediately. It is fraud to do a chargeback on an amount that you authorised. We will provide our bank with all proof that is required including screenshots of conversations, emails, your order, signed terms and conditions plus anything else that our merchant facility requires. Payment Plans 1. You acknowledge that if you take up a payment plan you cannot take the cruise or attend any event until it is paid in full. This is not negotiable. 2. Upon undertaking the payment plan, you agree to make the payments as agreed on booking form or when you checked out on our website. 3. If you are unable to make a payment at any time, you must notify Inspired Life Cruises email at least three (3) days prior to payment being due. 4. There will be a $20 administration fee added to your next instalment if a credit card or direct debit/credit payment is rejected/not paid on the date due or if you miss any payments and fail to let us know within the adequate notice period advised above. This is to cover fees charged to us by our financial institution, staff costs to process and chase up missed payments. 5. Missed payments must be caught up within a seven (7) days or you are at risk of cancellation. If your payment plan does go to cancellation, the cancellation policy will come into effect. Cooling Off Period 1. All Inspired Life Cruises events or cruises with a total cost in excess of $1,000 are subject to a seven (7) day cooling off period from the date that the booking form is signed. ©2020 Copyright protected to Inspired Life Cruises. The cooling off period for any events or cruises under $1,000 will be subject to a 48-hour cooling off period. 3. All cancellations within the applicable cooling off period must be received in writing via email to inspiredlifeeventsaustralia@gmail.com 4. For any bookings cancelled through the above process, during the cooling off period, you will receive a refund of the deposit less the retail cost of any non-returnable bonuses received such as books, digital products or USB’s etc and an administration fee of $50. 5. Money will be returned to your initial payment method i.e. credit card if paid on credit card or bank account if paid via a direct debit within 14 days of termination. 6. PLEASE NOTE ANY CANCELLATIONS OUTSIDE OF THE COOLING OFF PERIOD WILL BE SUBJECT TO THE CANCELLATION POLICY. These policies are strictly adhered too. Cancellation and Refund Policy 1. Please note that all cancellations made by you incur a $250 administration fee without exception. We recommend that you have and know the terms of your international insurance policy in relation to cancellation cover as we do not provide refunds for any reason outside the amounts listed in clause 3 below. 2. Please note that any cancellations received as a result of an Inspired Life Cruises postponement will incur a $50 administration fee and not the $250 administration fee. 3. Cancellations must be received in writing via email to inspiredlifeeventsaustralia@gmail.com at all times and as soon as possible. Verbal or cancellation via Facebook message is not considered as an official cancellation until the cancellation is received in writing to the above-mentioned email address. Any cancellation penalties will be calculated from the date that the cancellation is accepted in writing by Inspired Life Cruises. 4. Cancellations as a result of a postponement by Inspired Life Cruises must be received in writing to inspiredlifeeventsaustralia@gmail.com within 7 days of being informed of cruise or event postponement. 5. We do not cover under any circumstances any airfares or other expenses incurred that you have booked outside of us. This includes airfares and transfers to get to the cruise ship, pre or post accommodation surrounding your embarking the cruise ship. Please check your cancellation cover under your international travel insurance policy for refunds on these kinds of expenses. 6. The amount that you are refunded after this cancellation fee has been applied is dependent on how far you are cancelling from the date of departure. Please see the table below for full refund and cancellation details. Please note that should you cancel and the cancellation amount has not been paid you are still liable to cover this amount and we will seek to recover it by charging the card on file. 7. Please be aware that Any refunds will be processed back based on the method of payment as follows • Visa, Mastercard & American Express – refunds will be issued back to the card that made the payment. • Direct deposits – we will require your bank details including bank name, Account Name, BSB and account number to deposit into if you have paid this way. 8. If you choose to cancel, we reserve the right to replace you on the cruise in order to meet our minimum group number requirements regardless of whether you receive a refund or not. 9. Please make sure that your name is spelled correctly everywhere. Should you need to correct your name in the future and it is as a result of your error, a $50 fee may apply. 10. You are in some cases able to replace yourself by doing a name change for your cruise if at least one of the original guests in the cabin remains in the cabin. Should you want to sell your spot to someone else and the name on your booking be changed, there will be an administration fee of $100 that is applicable to change all our paperwork and the booking with P & O Cruises. 11. If all the original guests cancel or are replaced then the booking will be subject to the above cancellation policy and the applicable charges will be incurred. 12. Cruise Inclusions 1. Please note each room accommodates 2 persons and is priced per person in a twin share ocean view room. Other options are available upon request. If you are a solo traveller, a solo traveller supplement applies as per P & O Cruise’s terms and conditions. This is outside our control and cannot be waivered under any circumstances. 2. If you are a solo traveller, you may ask to occupy a twin share cabin with another solo traveller. Please note however you must be satisfied with the second traveller in your room as no provisions can be made for changing cabins. We do try wherever possible to match you with another event attendee, however sometimes this is not possible. This means we may require the match to be made by P & O Cruise’s from their waiting list. Who they match you with if this occurs is beyond our control as it is not able to be changed as previously mentioned. Alternatively, you can elect to pay the Single Supplement to have the cabin to yourself. 3. The cruise fare includes onboard twin share accommodation, main meals at most onboard restaurants (additional fees may apply to some menu items), entertainment and some activities onboard, gym and some fitness classes, as well as taxes, fees and port expenses. 4. Additional charges may apply to some entertainment (e.g. bingo and all casino activities) and activities, and main meals at onboard specialty restaurants. 5. A number of optional extras are also available that are not included in the cruise fare including drink purchases, some onboard activities and entertainment, shore excursions and tours, shopping, Wi-Fi internet, laundry services, day spa services, fitness classes and additional dining options. 6. Each booking will be assigned its own unique booking reference that you will be notified off closer to travel and once full payment has been received. 7. Occasionally P & O Cruises may upgrade you to a different room type without consultation at no extra charge. The higher room upgrade could be to any part of the ship and could also be on a lower deck. If you have a specific cabin that you want or do not wish to be considered for an upgrade, please let us know. Once the room allocation has been changed, it cannot be changed back. 8. Please note that even if you request not to be upgraded at times and at their discretion P & O Cruises may upgrade you for operational reasons that are outside our control. Insurance Requirements 1. We strongly recommend that you purchase the appropriate travel insurance at the time that you pay your deposit as you are not covered for any cancellations made by you and under any circumstances including emergencies and medical issues while onboard. 2. It is important that you purchase an international travel insurance policy for all voyages including domestic cruises that do not visit international ports. 3. If you do not purchase international travel insurance you may not be able to recover any charges, medical costs, repatriation, cancellation costs and other expenses that may be incurred if things do not go according to plan. ©2020 Copyright protected to Inspired Life Cruises. International cruises including those to the Pacific Islands require that you hold a current passport that is valid for the minimum duration required based on the countries that you are visiting. 2. Your passport must be valid for a minimum of six months beyond the date of your cruise return date and have sufficient blank pages for entry and exit stamps as well as visa’s. 3. You are responsible to ensure that you have all the necessary visa’s, vaccinations and travel documents in order to enter each country that the cruise. 4. Without the necessary passport, visa’s and/or vaccinations, local authorities may deny you boarding, prevent you from going offshore, issue you with a fine or deny the ship entry into the port. 5. It is your responsibility to ensure that you have all the necessary documentation which permits you to travel, including visa’s for ports which you do not intend to disembark. 6. We will not provide you with a refund or reimbursement for any expenses or losses incurred as a result of your failure to comply with these legal requirements. Domestic 1. For domestic cruises departing an Australian port (this includes Whitsunday and Moreton Island cruises) and not visiting any international ports, a valid visa or government issued photo identification is required. 2. Accepted forms of identification includes Driver’s License or Proof of Age Card and other government ID Cards. Please note that the older version of Queensland 18+ cards will not be accepted. 3. For Australian domestic cruises a current Medicare card can be used for guests under 18 years of age. We also recommend that you carry a copy of the child’s birth certificate with you. Pregnancy and Children 1. Guests who are pregnant at the commencement of the cruise are required to supply a doctor’s letter confirming they are fit to cruise, including the estimated due date prior to travel. 2. Guests who will have entered their 24th week of pregnancy and later are not able to travel on any cruise. 3. Due to limited infant and neo-natal facilities onboard and at destinations that we visit, the minimum age for children on domestic cruises is six (6) months and on all other itineraries twelve (12) months. 4. For the safety and enjoyment of all onboard, P & O Cruises limits the number of children that are permitted to cruise across different age brackets. 5. The age of the child on the day they board the cruise is the age that is used for the entire cruise and booking. 6. You may be told that you are not able to travel on a certain cruise if they have reached the max number of children in that age bracket on the cruise. 7. For safety reasons there needs to be at least one person that is 18 years or older in each room. However to accommodate families travelling together, P & O Cruises may allow children to occupy a different room as long as one children is older than 16 years of age. 8. There are some inherent features of cruise travel that can not be avoided and you should be prepared for. These could include things like noises and vibrations associated with the normal operation of the vessel, maintenance on certain areas of the ship can occur while you are onboard. 2. Weather conditions may also require that certain areas of the ship are restricted or shutdown completely for public safety. 3. Please note that we do not have exclusive occupancy of the ship and as such this means that we will be sharing facilities with people who are not in our tour group. 4. Please be advised that some people may experience motion or sea sickness while at sea. We recommend that you be prepared for this situation by visiting your doctor prior to embarking on the cruise. This is often made worse if the ship encounters bad weather conditions. Prohibited Items 1. To ensure a safe and enjoyable holiday for all guests, items that may pose a risk to the safety of other guests and crew are not allowed to be brought onboard. These include irons, kettle, coffee machines, bottle warmers, candles, heating devices, flammable liquids, weapons (including knives of any kind), hoverboards, remote control devices of any kind, drones. 2. Certain electrical appliances such as powerboards, surge protectors, laptops, phone charges, camera chargers and personal grooming devices such as shavers, curling irons, hair dryers, straighteners etc may be allowed onboard if they are deemed safe and in proper working condition. They may be confiscated and returned to you at the end of the cruise if believed to be a risk. 3. You are not permitted to have any outside alcohol, illegal drugs or illicit substances onboard 4. Beverage items such as plastic or glass bottled drinks (including water) and slabs of canned drinks or tetra pack drinks such as poppers cannot be brought onboard. 5. Each person may have a maximum of 12 canned )non-alcoholic) drinks loose in their luggage. Luggage 1. You must agree to allow all searches. Failure to do so may result in the ability to not board the ship or be removed at any port by government officials. If this occurs you will receive no refund and may incur extra costs as a result of failing to comply with instructions including fines, airfares, accommodation if the ship is forced to leave you behind. 2. All luggage, including hand and checked, will be x-rayed at embarkation. 3. Bags may be checked by staff and other parties such as port authorities and government agencies who are authorised on the journey legally to search your luggage and you 4. All purchases during your cruise will be subject to applicable quarantine and clearance procedures by local authorities upon disembarkation. When you check in, you will be asked to present a Visa, MasterCard or American Express which will be associated with your onboard “Cruise card”. 2. The Cruise Card is what you will use onboard for all onboard purchases, which are charged in Australian Dollars. 3. If you choose to register a Visa, MasterCard or American Express we will settle the outstanding balance on your onboard account to your registered card at the end of each day. 4. If the card registered has the name of the guest printed on the card then this must match the name of the guest’s photo ID used to embark the ship. 5. Service fees apply to all onboard credit card transactions. The service fee for Visa credit and MasterCard credit transactions is 1.1%. For American Express the service fee is 2.3%. There is no fee for Visa debit & MasterCard debit, or pre-paid/travel Visa & MasterCard transactions if the card is issued by a bank in Australia or New Zealand. Service fees are subject to change and will be advised onboard. 6. As an alternative to registering a Visa, MasterCard or American Express, you can add funds to your onboard account at the self-service cash kiosks onboard. The self-service kiosks allow you to top up your onboard account free of charge using cash or Australian Eftpos (cheque or savings accounts only) with an Australian issued bank card. 7. Non-Australian issued bank cards cannot be used in the self-service kiosk, but can usually be used in the ATMs onboard to withdraw Australian dollar currency. ATM fees apply. Circumstances Outside Our Control 1. While we do everything that we reasonably can to ensure that your cruise goes according to plan sometimes changes can occur that are outside our control that may affect your holiday experience. This could include an event speaker or facilitator cancelling, adverse weather conditions, mechanical difficulties, civil unrest, virus pandemics, cruise ship removed from service, parts of the ship closed or other unforeseen circumstances. 2. If it is necessary to change the itinerary due to safety, maritime law, severe weather, to protect human life, cancellation of an event facilitator, health or other factors outside our control, we will attempt to offer a revised itinerary as close to the original itinerary as possible. We will not provide any compensation in connection with the revised itinerary unless Consumer Laws require otherwise. 3. If an event facilitator cancels, we will attempt wherever possible to secure another presenter of the same calibre as the one cancelled. If this is not possible as the cancellation has occurred at short notice (under 21 days prior to travel), we will refund or credit at our sole discretion a portion of your cruise cost. 4. In addition, we or P & O Cruises may change the itinerary, ship or cancel the cruise due to operational or commercial requirements. Should this occur we will notify you as soon as we know details. 5. If we or P & O Cruises are forced to cancel a cruise for any reason prior to departure, we will provide you with a full refund or a credit transfer to another event. 6. Since the itinerary can never be fully guaranteed as per P & O Cruises’ terms and conditions please do not make any important arrangements or meetings on the proposed itinerary. ©2020 Copyright protected to Inspired Life Cruises. Wherever possible Inspired Life Cruises will never postpone a cruise or event, however sometimes the unforeseeable can arise. Any monies paid will be fully transferrable to another date and appropriate compensation will be decided on a case by case basis. 2. We reserve the right to change the change the schedule and timetable of events at our discretion. This can occur if a speaker or event facilitator becomes ill, something that occurs outside our control as described in ‘Circumstances Outside Our Control’ and for any other reason as we see fit. 3. Any cancellations after this period will be subject to normal cancellation and refund policy. 4. We will try wherever possible to give you as much notice as we can if this needs to occur. Copyright and Confidentiality 1. You agree that any recorded or written material included as part of your cruise is regarded as intellectual property of us and subject to Intellectual Property laws, including trademark & copyright laws. 2. You understand it may not be copied, distributed or used in any way without obtaining prior written permission from Inspired Life Cruises. 3. You agree not to record or make any reproduction of the whole or any part of this cruise. 4. All recordings we take will be kept confidential and will NOT be used in marketing or in the public arena without your express written permission after viewing the end recording. 5. You understand that it is vital that all discussions had in any event session are kept confidential to protect the privacy of yourself and others within the group. 6. You are not allowed to use the name Inspired Life Cruises (or any other names, taglines or trademarks adopted by Inspired Life Cruises) in any form in your name, business name, Facebook group or Facebook Business page, tagline, an external website name, your personal website address or extension, a website domain name, in an email address, as a personal name, or as a nickname. For example, you may NOT secure a domain name such as www.buyinspiredlifecruise.com or www.myinspiredlifecruises.com; NOR an email address such as inspiredlifecruises@gmail.com. Competition Clause 1. You agree that you will not create a business of similar nature within 3 years of your event or cruise with Inspired Life Cruises. Legal action may be initiated if this occurs at the discretion of Inspired Life Cruises. 2. You agree that you will not purchase any cruise, event or product for purpose of sourcing products elsewhere, taking products to other persons, business or organization to replicate in any country globally or attempting to make yourself unless permitted in writing by Inspired Life Cruises. 3. You agree to value our, our facilitators and presenter’s skills that they have taken time to develop. You will not in any way replicate our business model, trainings, events, documents or any other intellectual property acquired as a result of attending our events and cruises. Code of Conduct 1. There is NO ALCOHOL and RECREATIONAL DRUGS allowed at any event session unless otherwise stated. 5. You understand that drugs and alcohol can alter your event experience drastically. 6. You understand that if seen as being abusive, a deliberate distraction or negatively impacting the cruise and events you will be removed and may not be able to return. We will not give any form of reimbursement or refund if this occurs. Photography and Video Recording 1. We will be taking photographs and video throughout the duration of the cruise which may be used for marketing purposes. 2. By signing this form, you agree not to ask for or expect any compensation from audio, photographs or video if they are used for marketing purposes. 3. Inspired Life Cruises take no responsibility for the photographs and videos taken by any cruise participants. We ask that when you are taking photographs with your personal camera or phone, that you ask the person for their permission before taking their photo. 4. All photographs taken by yourself must only be used for personal memories or marketing our events only and you agree not to post them on any social media, website or in any marketing material without the express permission of those in the photograph. EVENT DISCLAIMER 1. You agree that participation in the events and cruises are of your own free will and you are responsible for your well-being at all times. You agree that you know of no reason nor have been informed by any doctor/health professional that your participation in such an event would cause any further medical/health issues. 2.
